FAQs about conveyancing.

What is conveyancing?

Conveyancing is the legal process of transferring ownership of a property from one party to another. It involves various legal and administrative tasks to ensure a smooth property transaction.

What is online conveyancing?

Traditional conveyancing practices often involve in-person meetings and physical document exchange, while online conveyancing leverages technology to manage the property transaction remotely. For clients in Queensland, our online conveyancing services operate without a traditional shopfront or physical office. Communication, document sharing, verification of identity, and updates are typically handled via email, video conferencing, and phone calls. The underlying legal requirements and processes for transferring residential property in Queensland remain the same whether you choose a traditional or an online conveyancer. We utilise the same electronic lodgement platforms (like PEXA – Property Exchange Australia) as traditional conveyancers for the settlement and registration of title. The use of these platforms for many property transactions has been mandatory in Queensland since February 2023.

Do I need a conveyancer in Queensland?

While it's not legally required to hire a conveyancer, it's highly recommended due to the complex legal and administrative aspects of property transactions. A conveyancer ensures all legal requirements are met.

What is the role of a conveyancer?

A conveyancer handles various tasks, including contract review, property searches, documentation preparation, and settlement coordination. They ensure the property transaction complies with all legal requirements.

What are ‘cooling-off’ periods in Queensland property transactions?

In Queensland, there is a standard five business day cooling-off period for residential property contracts. During this time, the buyer can withdraw from the contract without specific reasons, but they may forfeit a portion of the deposit.

What happens at settlement in Queensland?

At settlement, the legal ownership of the property is transferred to the buyer, and the purchase price is paid. This is when all financial transactions are completed, and both parties receive keys and access to the property.

What are common pitfalls to avoid in Queensland property transactions?

Common pitfalls include not conducting thorough property searches, failing to meet contractual deadlines, and not seeking legal advice. It's crucial to have a conveyancer to guide you through the process and avoid these issues.
