This can include identifying estate assets and liabilities applying for probate where required communicating with financial institutions managing property owned by the estate paying debts and distributing assets to beneficiaries. What is estate administration?

Estate administration refers to the full process of managing and finalising a person's estate after they have passed away. This can involve identifying assets applying for probate, transferring or selling property, paying debts and distributing assets to beneficiaries.

What is probate in Queensland?

Probate is the legal process of confirming that a Will is valid and giving the executor the authority to administer the estate. In Queensland, probate is granted by the Supreme Court of Queensland. Once probate is granted, the executor has legal authority to deal with banks and financial institutions, transfer or sell property owned by the estate, manage estate assets and liabilities and distribute assets to beneficiaries according to the Will. 

 

Many institutions will not release funds or allow property transfers until probate has been granted. This is why probate is often the first legal step in administering an estate.

Do all estates need probate in Queensland?

Not every estate requires probate. Whether probate is required depends on the type and value of the assets involved and the requirements of the institutions holding those assets. For example, probate is commonly required where the deceased owned real estate in their sole name where banks require confirmation of the executor authority or where the estate contains significant investments.

How long does probate take in Queensland?

Many executors want to know how long the probate process will take. The timeframe can vary depending on the complexity of the estate and how quickly the required documents can be prepared.

Once the application is lodged with the Supreme Court of Queensland it can take several weeks for the Court to review the documents and issue the Grant of Probate. 

​

Example 1:
Helping an executor through the estate administration process

A client recently contacted us after their parent passed away and they had been named as executor. The estate included property, bank accounts and investments.

Example 2:
Supporting a family where probate was not required
