Helping a client finalise an amicable separation
A client came to us after separating from their partner. The separation was amicable and both parties had already discussed and broadly agreed how their property and finances would be divided.
The client wanted to ensure the agreement was properly documented and legally finalised so that both parties could move forward with certainty.
We worked with the client to prepare the Consent Orders, reflecting the financial arrangements that had been agreed. As is standard practice we acted for one party only while the other party had the opportunity to obtain their own independent legal advice.
We then prepared and lodged the Consent Order application with the Federal Circuit and Family Court of Australia so the agreement could be formally approved by the Court. Once the orders were made the settlement was legally finalised and both parties were able to move forward knowing the financial arrangements had been properly documented.

Binding Financial agreements
Relationships often involve shared financial decisions about property assets and future financial arrangements.
Under Australian law, couples have the option of entering into a Binding Financial
Agreement – often referred to as a BFA.
Binding Financial Agreements can be made at different stages of a relationship, including before a marriage or relationship begins, during a relationship and after separation. In other parts of the world, agreements made before marriage are commonly called prenups.
In Australia these arrangements fall within the legal framework of Binding Financial Agreements under the Family Law Act.
