Title Amendments and Notice of Death or Survivorship in Queensland
Property titles are intended to accurately reflect the legal ownership of land.
However, over time it is quite common for issues to arise where the details recorded on the title need to be updated or corrected.
Sometimes this occurs after someone passes away. In other situations the issue is simply that the name recorded on the title does not match a person's full legal name. These types of title amendments must be lodged with Titles Queensland which has strict requirements about the documentation needed to update the register.
We assist clients throughout Queensland with preparing and lodging title amendment applications and notices of death or survivorship. Importantly, our firm is an authorised
eLodgement user of the Titles Queensland system.
Where the relevant form is available through the eLodgement platform, we may be able to lodge the application directly with Titles Queensland on our client’s behalf. In situations where a form cannot be lodged electronically, we will prepare the required documentation and arrange for it to be lodged manually with the Titles Office.

Example 1:
Updating a title after a joint owner passed away
A client contacted us after their spouse passed away. The family home had been owned as joint tenants. While ownership automatically passed to the surviving spouse, the title still recorded both names.
We prepared and lodged the Notice of Death and Survivorship, ensuring the register was updated to show the surviving spouse as the sole owner.

Correcting a name recorded incorrectly on a title
In another situation, a client contacted us after discovering that the name recorded on their property title did not match their full legal name. The property had been purchased many years earlier when identity verification requirements were less strict. The title recorded a shortened version of their name that no longer matched their identification documents.
We assisted by preparing the required documentation and lodging the title amendment application with Titles Queensland so the register accurately reflected their full legal name.
